1. WHO ARE WE?

EL-FAALYAT AL-MATALEQA with a registered address Office No. 43 & 44, 2nd Floor Al Thumama Road, Al Nada District Riyadh, Kingdom of Saudi Arabia.(“ATHAR”, “we”, “us”, “our”) makes the ATHAR website (www.atharfestival.com), the ATHAR App,  events including ATHAR Festival and related services (together and separately herein, the “Platform”) available to users as set out in our Terms & Conditions, of which this Privacy Policy (“Policy”) forms a part. Capitalized terms not defined herein are defined in the Terms & Conditions. This Policy should be read together with the Terms & Conditions.

2. WHAT DOES THIS PRIVACY POLICY COVER?

2.1 ATHAR takes data protection seriously and processes your personal data in accordance with applicable laws and regulations. ATHAR acts as the ‘controller’ (i.e. person responsible for deciding how your personal data is processed) and has adopted this Policy to ensure clarity around how it processes your personal data.

2.2 This Policy:

    1. sets out the types of personal data we collect about you;
    2. explains how and why we collect and use your personal data;
    3. explains how long we keep your personal data;
    4. explains how we will share your personal data – when, why and who with;
    5. explains the different rights and choices you have when it comes to your personal data;
    6. explains the security measures we apply to protect your personal data; and
    7. explains how we may contact you and how you can contact us.

2.3 Please understand that by accepting this Policy and submitting any personal data to us, you agree that we may collect, use, disclose and retain such data in accordance with this Policy and our Terms & Conditions, and as permitted or required by law. If you do not agree with this Policy, then please do not accept them or provide any personal data to us.

2.4 Please also note that you will not be able to use the Platform, or enjoy its full functionality, unless you provide us with the required personal data (unless we indicate the supply of the personal data is optional in any instance).

2.5 We will not process your personal data except for the purposes for which it has been collected or where we are permitted to do so by law.

3. WHAT PERSONAL DATA DO WE COLLECT, AND HOW DO WE COLLECT IT?

3.1 We collect the content, communications, payment and other information you provide when you use the Platform. including when you sign up for an account or place orders using the Platform. This includes your name, email address, mobile, nationality, gender and your location. At our events, we may also collect such information, as well as photographs, sound recording or video footage of you at our events.

3.2 We also collect the following personal data:

    1. Usage: we collect information about you, such as the type of events you are interested in, and the time, frequency and duration of your activity on the Platform.
    2. Device information: we collect information on the devices you use, such as the model and kind of the device you are using to access our services, the operating system, hardware and software version together with other technical information (e.g. your IP address).
    3. Your opinions about our Services: information you share rating your experiences and satisfaction with the provision or receipt of our services via the Platform together with any information you share about any disputes.

3.3 We also use cookies to collect personal data from your device to help us enhance the services provided, and to ease your access to our services, for example they allow you to repeatedly use our services on the same device without having to login or adjust the preference settings each time. We collect web statistics automatically about your visit to our Platform based on your IP address. This information is used to help us in improving your experience on our Platform.

3.4 Ads appearing on our site may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognise your computer each time they send you an online advertisement to compile non personal identification information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This privacy policy does not cover the use of cookies by any advertisers.

4. FROM WHERE DO WE COLLECT PERSONAL DATA ABOUT YOU?

We collect your personal data directly from you i.e. this is the personal data you provide to us when using our Platform, from other users of the Platform, and through publicly available sources including your social media channels if you connect them with the Platform.  We also collect your personal data by deploying cookies as described above. We may also collect personal data from you onsite at any of our events, and this can include personal data in the way of photographs, video and sound recordings, as well as other personal data as contemplated above.

5. HOW AND WHY DO WE USE YOUR PERSONAL DATA?

5.1 We use your personal data for the following purposes:

    1. send you information in connection with the Platform;
    2. to send periodic emails about our other services;
    3. to run a promotion, contest, survey or other site feature
    4. to promote, advertise and market our events on digital or non-digital media platforms
    5. to send you information in relation to topics that might be of interest to you.
    6. respond to your communications and requests;
    7. provide the Platform to you;
    8. to customize the content and services we provide through the Platform;
    9. to help us better understand your interests and needs, and improve the Platform;
    10. to engage in analysis, research, and reports regarding use of the Platform;
    11. to secure the Platform;
    12. to comply with any procedures, laws, and regulations which apply to us where it is necessary for our legitimate interests or the legitimate interests of others;
    13. establish, exercise, or defend our legal rights where it is necessary for our legitimate interests or the legitimate interests of others;
    14. prevent and detect crime and fraud;
    15. protect health and safety and to ensure security;
    16. comply with contractual requirements; and
    17. carry out our internal business purposes, such as corporate transactions, audits, and data analysis

5.2 Were we are required to do so by law, we will ask for your specific consent in respect of usage such as the sending of promotional communications, or where we share personal data with third parties for the purposes contemplated in this Policy; or where we use your personal data for purposes other than those communicated already in this Policy.

6. HOW LONG DO WE KEEP YOUR PERSONAL DATA FOR?

We keep your personal data for no longer than necessary for the purposes for which it is processed or when you delete your account on the Platform (whichever comes first). When you delete your account, you will not be able to access the deleted data or recover it. The length of time for which we retain personal data typically depends on the purposes for which we collected and use it and/or as required to comply with applicable laws.  Once we no longer need to keep your personal data we will take reasonable steps to erase it from our systems and ensure it is erased from those systems where it is processed on our behalf.

7. WHO DO WE SHARE YOUR PERSONAL DATA WITH?

We may share your personal data with the following:

  1. New owner: If the ownership or control of ATHAR, or all or part of the Platform changes, we may transfer your information to the new owner.
  2. Business partners, affiliates and advertisers: We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined under section 5 above. .
  3. Third party service providers: we may work with third-party partners (including IT providers) to improve and provide the Platform, and we might need to share some of the your information with these persons; however we impose restrictions on how these persons can use and disclose the data we provide in accordance with applicable laws and regulations.
  4. Government authorities: ATHAR may share your personal data with government authorities if required to do so in accordance with applicable law; to establish and/or enforce our rights (including under this Policy and the Terms & Conditions) or to protect our property; to defend against legal claims; or as otherwise required by law. We reserve the right to raise or waive any legal objection or right available to us.

By accepting this Privacy Policy you consent to the above sharing and disclosure of your personal data to the extent your consent is a requirement in order for the disclosure to lawfully take place under applicable laws and regulations.

8. THIRD PARTY LINKS AND FEATURES

The Platform may contain links to third-party websites such as our partners, suppliers, advertisers, sponsors, licensors. such sites would include social media sites, and also may contain third-party integrations and functionalities. If you choose to use these sites or features, you may disclose your personal data not just to those third-parties, but also to their users and the public more generally depending on how their services function. ATHAR is not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your personal data will be subject to the privacy policies of the third-party websites or services, and not this Privacy Policy. We urge you to read the privacy and security policies of these third-parties.

9. CHILDREN’S PRIVACY

If you are under the age of (18) you must obtain the consent of your legal guardian (for example a parent) to use our Platform and to the processing of personal data in accordance with this Privacy Policy.

10. STORAGE AND INTERNATIONAL TRANSFERS

ATHAR may subcontract the processing of your data to, or otherwise share your data with, service providers located inside or outside the Kingdom of Saudi Arabia.  Such third parties may be engaged in, among other things, the provision of goods and services to you, the processing of transactions, payments and/or the provision of support services. By accepting this Policy, you agree to any such transfer, storage or use. We will fulfil any requirements in relation to the international transfers of personal data under applicable laws.

11. SECURITY OF YOUR PERSONAL DATA

We consider the confidentiality and security of your personal data to be of the utmost importance. ATHAR takes a variety of technical, administrative, and physical measures to protect your information from disclosure to or access by third parties. Please note that we do not guarantee the security of personal data, as no method of internet transmission or storage is completely secure.

12. CHANGES TO THIS POLICY

Please note that we review our privacy practices from time to time, and that these practices are subject to change. Any change, update, or modification will be effective immediately upon posting on our Platform.  If we make a material change to the Policy, you will be provided with appropriate notice in accordance with legal requirements. Continued use of the Platform by you confirms your acceptance of such revised terms, and your consent to continue processing your personal data.

13. YOUR RIGHTS

13.1 You have certain rights under and in accordance with applicable laws and regulations including:

    1. The right to be informed – to inform you of the valid legal or practical justification for collecting your personal data, and the purpose of such collection, and that your personal data should not be processed later in a manner inconsistent with the purpose for which it is collected.
    2. The right to have access to your personal data – the right for you to have access to it and obtain a copy of it
    3. The right to request correction, completion or updating of your personal data that ATHAR controls.
    4. The right to request the destruction or deletion of your personal data which ATHAR no longer needs to process for the purposes for which it was collected.
    5. The right to withdraw your consent at any time, where we relied on your consent to use and disclose your personal information. If you do this we may not be able to provide the Platform and Products to you.

You can exercise your rights set out at (a) to (e) above by contacting us and they are subject to any exemptions permitted by applicable laws and regulations or otherwise required to protect the rights of others. We may ask you to provide suitable identification when you seek to make any of these requests, in order to verify your identity.
